Tutor Terms & Conditions
By using the LearnOn! website, the LearnOn! system and tutoring students through LearnOn!, tutors agree to the following:
1.Tutors must refuse to be left unaccompanied with any student under the age of 16.
2.Tutors am responsible for behaving in a professional manner at all times.
3.Tutors will be held personally accountable for any inappropriate, illegal or questionable behavior. 4.Tutors must refuse direct payment by student, LearnOn! will pay me for all my hours tutored.
5.LearnOn! is not liable for any damages, which occur to my person or property as a result of LearnOn! tutoring sessions, and tutors absolve LearnOn! of any responsibility by entering into this agreement.
6.By entering into this agreement with LearnOn! tutors absolve LearnOn! for liability, actions or claims for any damages, in all areas of law, including but not limited to criminal, tort, contract, property and others. 7.Tutors understand that all company and client information is strictly confidential and distribution is strictly prohibited.
8.Tutors understand that in order for parents and students to feel comfortable having you in their home you must follow a certain code of conduct. This includes being prepared, being on time, being polite and personable, and arriving properly dressed.
9.Dress Code: Casual dress attire. You MUST avoid ripped and offensive clothing, and "cultural dress". 10.Tutors are responsible for filling out all the online administrative forms accurately and clearly and responding to all LearnOn! administration calls/emails pertaining to any assigned students within 24 hours. 11.Tutors are responsible for updating and submitting online hour records accurately and properly by the end of each calendar month.
12.LearnOn! tutors are prohibited to make direct tutoring arrangements with LearnOn! clients while being under contract with LearnOn! and for a period of two (2) years after contract is terminated.
13.LearnOn! tutors can not offer services similar to those offered by LearnOn! for a period of ten (10) months after termination of this agreement, unless granted written consent by LearnOn!
14.Tutors agree that students, client, referrals and leads to prospective students belong to LearnOn! Tutoring. Tutors agree that any breach of this provision may be considered theft of property and may result in legal action against the tutor at fault, if legal action is taken against a tutor, the tutor will be responsible for all legal expenses incurred by LearnOn! Tutoring.
15.In order to enforce the above policies, LearnOn! may at any time and at its sole discretion, present a tutor with a "mystery client" commissioned by LearnOn! to verify that the Tutor is complying to all agreements and policies presented to them by LearnOn!
16.Tutors will be paid at the beginning of the month for all hours worked the previous month. Compensation will be based on the tutor posting or the amount agreed upon with LearnOn! for that particular session.
17.Tutors understand that they will not be paid if they signed up for a session that they were not prepared for nor had sufficient knowledge to conduct and therefore was not done to the satisfaction of the student and/or LearnOn! Tutoring.
18.LearnOn! Tutoring shall not be liable for any expenses paid or incurred by myself unless otherwise agreed to ahead of time in writing.
19.Tutors are independent contractor, and will not be an employee of LearnOn! Tutoring and will not be entitled to participate in or to receive any benefits or rights from LearnOn! Tutoring's employment benefits or welfare plans including but not limited to any pension plans, health plans, disability insurance, and workers compensation insurance.
20.Tutors understand that as an independent contractor no income tax, payroll tax or any form of government payments will be withheld or paid by LearnOn! Tutoring on behalf of the tutor and therefore the tutor is responsible for reporting any earnings paid to them by LearnOn! Tutoring.
